Terms of Service
These Terms of Service (hereinafter referred to as "Terms") set forth the terms and conditions for the use of services (hereinafter referred to as "Services") provided by the operator of this website (hereinafter referred to as "Operator"). All users (hereinafter referred to as "Users") shall use the Services in accordance with these Terms.
Article 1: Application
1. These Terms shall apply to all relationships regarding the use of the Services between Users and the Operator.
2. The Operator may establish rules, etc. for the use of the Services (hereinafter referred to as "Individual Regulations") in addition to these Terms. These Individual Regulations shall constitute a part of these Terms regardless of their names.
3. If provisions of these Terms conflict with provisions of the Individual Regulations mentioned in the preceding paragraph, the provisions of the Individual Regulations shall prevail unless otherwise specified in the Individual Regulations.
Article 2: Registration
1. For the Services, registration shall be completed when a prospective registrant applies for registration in the manner prescribed by the Operator after agreeing to these Terms, and the Operator approves the application.
2. The Operator reserves the right to refuse registration if the prospective registrant has previously violated these Terms or falls under any of the grounds for termination of user registration as specified in Article 10.
Article 3: Management of User ID and Password
1. Users shall manage their user ID and password for the Services at their own responsibility.
2. Users shall not allow any third party to use their user ID and password, nor shall they transfer or lend them to any third party.
3. Any damage caused by inadequate management of the user ID and password, misuse, or use by a third party shall be the responsibility of the User, and the Operator shall not be liable for any such damage.
Article 4: Prohibited Matters
Users shall not engage in any of the following acts when using the Services:
- Acts that violate laws and regulations or public order and morals
- Acts related to criminal activities
- Acts that destroy or interfere with the functions of the Operator's server or network
- Acts that may interfere with the operation of the Services
- Acts of collecting or accumulating personal information about other users
- Acts of impersonating other users
- Acts of directly promoting, advertising, soliciting, or operating business to other users of the Services
- Acts that cause disadvantage, damage, or discomfort to other users of the Services or third parties
- Acts that damage the reputation or credibility of the Operator
- Acts that post or transmit harmful computer programs or other similar items
- Acts that exploit vulnerabilities in the Services
- Other acts that the Operator deems inappropriate
Article 5: Suspension of Service Provision
1. The Operator may suspend or interrupt the provision of all or part of the Services without prior notice to Users in any of the following cases:
- When performing maintenance or updates of computer systems related to the Services
- When the provision of the Services becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
- When computers or communication lines stop due to an accident
- Other cases where the Operator deems it difficult to provide the Services
2. The Operator shall not be liable for any disadvantage or damage caused to Users or third parties due to the suspension or interruption of the provision of the Services.
Article 6: Copyright
1. Users shall not engage in acts that infringe or may infringe on the intellectual property rights of the Operator or third parties in relation to the use of the Services.
2. Any text, images, videos, etc. posted by Users using the Services shall be deemed to have been licensed to the Operator to the extent necessary for the provision of the Services.
Article 7: Restriction of Use and Cancellation of Registration
1. The Operator may, without prior notice, delete posted content, restrict the use of all or part of the Services, or cancel user registration in any of the following cases:
- When the User violates any provision of these Terms
- When a falsehood is discovered in the registration information
- When the User has not used the Services for a considerable period
- When the User has not responded to contact from the Operator for a considerable period
- Other cases where the Operator deems it inappropriate to continue using the Services or maintain user registration
2. The Operator shall not be liable for any damage caused to the User by actions taken by the Operator pursuant to this article.
Article 8: Disclaimers and Warranties
1. The Operator does not guarantee that the Services are free from bugs or other defects.
2. The Operator shall not be liable for any damage caused to Users in relation to the use of the Services, except in cases of intentional or gross negligence by the Operator.
3. Even in the case of the preceding paragraph, the Operator shall not be liable for any damage caused by special circumstances (including cases that the Operator or Users could foresee and cases that they could not foresee) arising from transactions between the Operator and Users in relation to the use of the Services.
4. The Operator shall not be liable for any transactions, communications, or disputes arising between Users and other users or third parties in relation to the Services.
Article 9: Changes to Terms
1. The Operator may change these Terms without individual notice to Users when deemed necessary.
2. Unless otherwise specified by the Operator, changes to these Terms shall take effect from the time they are posted on the Service's website.
3. After the change of these Terms, Users shall be deemed to have agreed to the changed Terms by continuing to use the Services.
Article 10: Handling of Personal Information
The Operator shall handle personal information obtained through the use of the Services appropriately in accordance with the "Privacy Policy" separately established by the Operator.
Article 11: Governing Law and Jurisdiction
1. The interpretation of these Terms shall be governed by the laws of Japan.
2. Any disputes arising in relation to the use of the Services shall be subject to the exclusive jurisdiction of the district court having jurisdiction over the location of the Operator's head office.
